Article 4 Conditions for drawing up declaration of performance 1.

They shall draw up the declaration of performance in accordance with Articles 4, 5 and 6.

The manufacturer or the importer may make a declaration of performance where the requirements referred to in point (b) do not exist.

Member States shall presume the declaration of performance drawn up by the manufacturer or the importer to be accurate and reliable.

If a declaration of performance has not been drawn up, CE marking should not be affixed.

The declaration of performances shall be drawn up using the model set out in Annex III.

Our group is of the opinion that all information known to the manufacturer should be included in a declaration of performance, including information about hazardous substances.

Clarify the affixing of CE marking to construction products for which the manufacturer has made a declaration of performance.

To the same end - and this will be my fourth point - we have helped to significantly enhance the user information provided by manufacturers in the declaration of performance.

Key issues included the declaration of performance or CE marking, where a successful agreement was made to ensure micro-enterprises do not face the same burdens as larger companies.

The declaration of performance referred to in paragraph 1 shall cover at least the essential characteristics for which requirements referred to in point b of paragraph 1 exist.

The manufacturer draws up an EU declaration of conformity or a declaration of performance (for Construction Products) and affixes the CE marking on the product.

The declaration of performance shall express the performance of construction products in relation to the essential characteristics of those products in accordance with the relevant harmonised technical specifications.

In order to set straight the development course of performance art in China, Xing Xin publicly announced his Declaration of Performance Art on August 26, 2012.

It is necessary to provide for simplified procedures for drawing up declarations of performance in order to alleviate the financial burden of SMEs and in particular of micro-enterprises.

Once again, in Strasbourg, we have adopted a regulation that harmonises the conditions for the marketing of construction products and ensured that the 'declaration of performance' of each product includes information on hazardous substances.

The testing procedure, which is laid down in detail in EN 54, must be carried out by the approved notified body and the official certificatory Declaration Of Performance should be provided by that body.

One important point to make at the same time is that the regulation's implementation will help keep to a minimum the occurrence of unintended non-conformities of construction products with their declaration of performance, which will minimise material losses.

When no requirements related to the essential characteristics of construction products exist where the manufacturer intends to place the product on the market, he should be allowed to place such a product on the market without a declaration of performance.

In order to allow manufacturers and importers of construction products to draw up a declaration of performance for construction products which are not covered by a harmonised standard it is necessary to provide for a European Technical Assessment.

Manufacturers shall keep the technical documentation and the declaration of performance for the period determined by the Commission for each family of construction products on the basis of expected life and the role of the construction product in the works.

Manufacturers and importers may make a declaration of performance on the basis of a certificate of conformity or a declaration of conformity, which has been issued before 1 July 2011 in accordance with Directive 89/106/EEC.

Methods intended to reduce the cost of testing – Introduction of a soft system where the manufacturer’s declaration of performances is simply supported by a Specific Technical Documentation (STD), which the manufacturer keeps in the factory at disposal of the market surveillance authorities.
