The question is whether that middle ground will be applied by American courts.
Among other things, American courts give defendants access to much of the government's evidence against them.
And there is no place for either in American courts.
This could never have come to trial in an American court.
This was no American court of law, equal justice and all that.
In an American court of law, the prosecuting attorney is always the first to present his case.
But they are unlikely to appear in an American court anytime soon.
They do not claim a right to have the American court systems review their cases.
Like all treaties, it has the full force of law in American courts.
